Nature of Services
Upsuh Services is a service coordination platform. It allows users to:
- Discover and browse service offerings from our Service Partners.
- Book and schedule appointments.
- Pay Cibocon Systems Ltd. for the selected services.
Cibocon acts as the customer to the Service Partner on behalf of our users. Users pay Cibocon, and Cibocon then pays the Service Partner. At no point is Cibocon acting as a regulated payment processor or financial intermediary.
User Eligibility
- At least 18 years old; or
- 13 years or older with permission from a parent or legal guardian.
You agree to provide accurate and up-to-date personal information and to use the App in compliance with applicable Jamaican laws.
Service Fulfillment and Responsibility
- Service Partners are solely responsible for the quality, pricing, timeliness, and delivery of the services they offer.
- Cibocon does not control or guarantee the outcome of services provided by third-party businesses.
- Disputes regarding the quality or delivery of services must be directed to the Service Partner.
Payments
- When you book a service, you agree to pay Cibocon the amount shown at checkout.
- Cibocon, in turn, pays the Service Partner as a customer for fulfilling that service.
- Cibocon is not a financial institution or payment gateway, and does not store your full payment credentials.
- All payments are handled securely by our third-party payment processor(s), in accordance with industry standards.
Cancellation and Refunds
- Each Service Partner sets their own cancellation and refund policies.
- Users must review the applicable cancellation terms before confirming a booking.
- Cibocon will only process refunds if authorized by the respective Service Partner.
Privacy and Data Protection
We are committed to protecting your privacy and handling your data responsibly.
- Your personal data is collected, processed, and stored in accordance with the Jamaica Data Protection Act (DPA).
- By using the App, you consent to the collection and use of your information as outlined in our Privacy Policy.
- We do not sell your personal data to third parties.
Intellectual Property
- The App, including the name Upsuh Services, the Upsuh system, and all associated trademarks, content, and software, are the property of Cibocon Systems Ltd. or its licensors.
- You may not copy, modify, distribute, or reverse-engineer any part of the App.
Limitation of Liability
To the fullest extent permitted by law:
- Cibocon disclaims all liability for service issues, injuries, damages, or losses caused by or related to Service Partners.
- Cibocon will not be liable for indirect, incidental, or consequential damages arising from your use of the App.
Termination
- Cibocon reserves the right to suspend or terminate your access to the App at any time for violations of these Terms.
- We may also discontinue or modify any part of the App with or without notice.
Amendments
We may update these Terms from time to time. When we do, we’ll notify you via the App or by email. Continued use of the App after changes means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of Jamaica. Any disputes shall be resolved in the courts of Jamaica.
